You are about to access the Amadeus computer reservations system.
As with the use of all computer reservation systems, including online travel sites, that provide you with travel information and data, you are required to agree to standard terms and conditions of use. These standard terms and conditions appear below.
You agree that your use of this Reservations Module to access the Amadeus computer reservations system (the “System”) is expressly conditioned on your agreement to the following terms and conditions (the “Agreement”). .
1. Ownership of Data and Marks
All information and data (“Data”), and all trademarks, logos and service marks (“Marks”) displayed on the Reservations Module and the System are the exclusive property of, and the Marks are the registered and common law Marks of, Amadeus Global Travel Distribution LLC, its affiliates, vendors, travel information providers, distributors, contractors and their respective affiliates (“System Participants”). Therefore, you agree that you will not reproduce, sell, transfer, modify, redistribute, retransmit, publish and/or or commercially exploit the Data or Marks without the express written permission of the entity that owns the Data or Marks. Your access or use of the System does not grant, expressly or otherwise, any license or right to use any of the Data or Marks.
2. Use of System.
The System may only be used to obtain and book travel related services and no other purpose. The System may not be used to make any speculative, false or fraudulent reservation or any reservation in anticipation of demand. You understand that unauthorized use of the System, the Data or the Marks may violate applicable copyright, trademark or other intellectual property laws or other laws. You may not post or transmit through or on the System any (a) libelous, defamatory, obscene, indecent, inflammatory, pornographic, threatening, discriminatory or profane material or (b) material that could constitute or encourage conduct that would be considered a violation of any law or give rise to civil liability.
3. Age and Responsibility
You must be of sufficient legal age to use the Site. You agree that you are responsible for all uses of the Site by you or those using your login information. You will be responsible for any damages caused by your improper or unauthorized use of the Site.
4. Privacy.
You have read and agree to the Privacy Policy, which is incorporated herein by reference. You consent to the use of your personal data and information by the Site Participants pursuant to the Privacy Policy.
5. WARRANTY DISCLAIMER.
NO SYSTEM PARTICIPANT, INCLUDING, BUT NOT LIMITED TO, ANY SUCH ENTITY PROVIDING ANY INFORMATION, CONTENT OR DATA CONTAINED IN THIS SYSTEM, MAKES ANY WARRANTY OF ANY KIND REGARDING THIS SYSTEM AND/OR ANY INFORMATION, CONTENT OR DATA PROVIDED ON OR THROUGH THIS SYSTEM, ALL OF WHICH ARE PROVIDED ON AN "AS IS" BASIS. FURTHER, NO SYSTEM PARTICIPANT WARRANTS THE ACCURACY, COMPLETENESS, CURRENCY OR RELIABILITY OF ANY OF THE INFORMATION, CONTENT OR DATA FOUND ON THIS SYSTEM, INCLUDING, BUT NOT LIMTED TO, ITS AVAILABILITY, ACCESS, ACCURACY OR TIMELINESS, AND SUCH PARTIES EXPRESSLY DISCLAIM ALL WARRANTIES AND CONDITIONS, INCLUDING IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT AND THOSE ARISING BY LAW, COURSE OF DEALING OR USAGE OF TRADE. SOME JURISDICTIONS DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES, SO THE FOREGOING DISCLAIMER MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC RIGHTS WHICH MAY VARY FROM JURISDICTION TO JURISDICTION.
6. LIMITATION OF LIABILITY.
NO SYSTEM PARTICIPANT ASSUMES RESPONSIBILITY, AND SHALL NOT BE LIABLE FOR, ANY DAMAGES TO, OR VIRUSES THAT MAY INFECT YOUR COMPUTER EQUIPMENT OR OTHER PROPERTY ON ACCOUNT OF YOUR ACCESS TO, USE OF, OR BROWSING IN THE SYSTEM OR YOUR DOWNLOADING OF ANY CONTENT, MATERIALS, DATA, TEXT, IMAGES, VIDEO OR AUDIO FROM THE SYSTEM. IN NO EVENT SHALL ANY SYSTEM PARTICIPANT BE LIABLE FOR ANY INJURY, LOSS, CLAIM, DAMAGE, DIRECT OR OTHERWISE, INCLUDING ANY CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, INDIRECT OR INCIDENTAL DAMAGES OF ANY KIND (INCLUDING, BUT NOT LIMITED TO LOST PROFITS, REVENUE OR SAVINGS), OR ANY COST OR EXPENSE, WHETHER BASED IN CONTRACT, TORT, WARRANTY, STRICT LIABILITY OR OTHERWISE, WHICH ARISES OUT OF OR IS IN ANY WAY CONNECTED WITH (A) ANY USE OF THE SYSTEM OR INFORMATION, CONTENT OR DATA DISPLAYED IN THE SYSTEM, (B) ANY FAILURE OR DELAY (INCLUDING, BUT NOT LIMITED TO THE USE OF OR INABILITY TO USE ANY COMPONENT OF THIS SYSTEM) OR (C) THE PERFORMANCE OR NON PERFORMANCE OF ANY AND ALL SERVICES PROVIDED ON THIS SYSTEM BY ANY SYSTEM PARTICIPANT, EVEN IF THE SYSTEM PARTICIPANT HAS BEEN ADVISED OF THE POSSIBILITY OF ANY SUCH DAMAGES. IF FOR ANY REASON THE FOREGOING LIMITATION DOES NOT APPLY, THE LIABILITY OF ANY AND ALL SYSTEM PARTICIPANTS SHALL NOT EXCEED, IN THE AGGREGATE, THE GREATER OF $100 USD. SOME JURISIDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS ON LIABILITY, THUS THE FOREGOING LIMITATION(S) MAY NOT APPLY TO YOU. ANY OTHER LIABILITY OWED TO YOU BY ANY SYSTEM PARTICIPANT SHALL NOT ARISE EXCEPT AS MAY BE EXPRESSLY AGREED IN WRITING BETWEEN YOU AND THE SYSTEM PARTICPANT.
7. Site Links.
The Site contains links to other
web sites which are provided solely as a convenience to you and not as an
endorsement by any Site Participant. You assume all risk in accessing any other
web site through the Site. No Site
Participant shall be responsible for the content of any other web sites and
make no representation or warranty regarding any other web site or any content,
data or information on such web sites.
8. Governing Law and
Jurisdiction.
This Agreement and its performance shall be governed by the laws of the state of Florida, without regard to its conflict of laws provisions. Florida venues will be the site for any dispute or controversy arising out of this Agreement or your use of the System.
9. Severability.
These terms and conditions shall
be deemed severable. In the event that any provision is determined to be
unenforceable or invalid, such provision shall nonetheless be enforced to the
fullest extent permitted by applicable law, and such determination shall not
affect the validity and enforceability of any other remaining provisions. Notwithstanding the severance of any term or
condition herein, the court shall reconstruct such severed term or condition so
as to make it comply with applicable law and to effect as near as possible the
intention of such severed term or condition.
10. Entire Agreement.
These terms and conditions constitute the entire agreement between us relating to the subject matter hereof, and supersedes any prior understandings or agreements (whether oral or written) regarding the subject matter, and may not be amended or modified except in writing or by making such amendments or modifications available on this System.
